Momentum is made by Epsilon Limited Solutions LLC, a company in Albuquerque, New Mexico. You get a personal licence to use the app. Your tasks are yours — we don't claim any rights over them and we can't see them. The app is sold through Apple, so Apple handles payment and refunds. The AI features are optional and depend on services we don't control. We build this carefully, but no software comes with a guarantee, and there are limits on what we can be held responsible for. Everything below says the same things at more length.
These terms are an agreement between you and Epsilon Limited Solutions LLC ("Epsilon", "we", "us"), the developer of Momentum. They cover the Momentum apps for macOS, iPadOS and iOS, the beta program, this website, and the optional AI service we operate.
By installing or using Momentum, or by joining the beta, you accept these terms. If you don't accept them, don't use the app.
We grant you a personal, non-exclusive, non-transferable licence to use Momentum on devices you own or control, in line with the App Store terms that apply to your purchase or beta participation.
Momentum is distributed through Apple's App Store and TestFlight. Apple's Licensed Application End User License Agreement also applies to your use of the app. Where these terms and Apple's terms conflict on the licence itself, Apple's terms control. These terms cover everything else, including the AI service and this website.
You may not sell, rent, sublicense or redistribute the app, attempt to extract its source code except where the law expressly permits it, or remove any notices from it.
Momentum is currently offered as a beta through TestFlight. Beta software is provided as-is and by definition is not finished:
If we ask you not to share screenshots or details of unreleased features, please honour that. Otherwise, you're free to talk about the app publicly, including saying what you think of it.
When Momentum is sold, it is sold through the App Store. Apple is the merchant of record: Apple processes your payment, issues receipts, and handles refunds under its own policies. We can't process a refund on Apple's behalf.
If you have a billing problem, contact Apple. If you have a problem with the app, contact us — we'd rather hear about it and fix it.
Prices may change over time. A change never affects a purchase you've already made.
Your tasks, projects, notes and everything else you create in Momentum belong to you. We claim no ownership of them and no licence to use them.
Momentum stores your data locally on your device and, if you enable iCloud sync, in your own private iCloud database under your Apple ID. We have no access to it. Full detail is in the Privacy Policy.
Because your data lives on your devices and in your iCloud account, keeping backups is your responsibility. Momentum can export your data, and we recommend you do so periodically.
Momentum includes optional AI features, such as inbox triage and project planning. They only run when you invoke them. When you do, the text of the items being processed is sent for analysis, either through a proxy service we operate or directly to Anthropic under your own API key if you provide one. What is sent and what is retained is described in the Privacy Policy.
Some things to know about these features:
Don't use Momentum or our services to break the law, to infringe someone's rights, to attack or overload our infrastructure, or to gain unauthorized access to any system. Don't attempt to circumvent the authentication on our AI service or use it outside the app.
Momentum relies on services we don't control, including Apple's App Store, TestFlight, iCloud and EventKit, Amazon Web Services, and Anthropic's models. Your use of those services is governed by their own terms, and we aren't responsible for their acts or omissions.
We may update Momentum, change its features, or stop offering it or any part of it. We'll try to give reasonable notice of anything significant through release notes or email. Momentum's core is local-first and keeps working offline, which is deliberate: if our services went away tomorrow, the app on your Mac would still open your data.
To the maximum extent permitted by law, Momentum and our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that it will meet your requirements.
Some jurisdictions don't allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any consumer rights you have that can't be waived by agreement.
To the maximum extent permitted by law, Epsilon will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of Momentum, however caused and on any theory of liability.
To the maximum extent permitted by law, our total liability for all claims relating to Momentum is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five US dollars.
Again, some jurisdictions don't allow these limits, and nothing here affects rights you have that can't be waived.
You can stop using Momentum at any time; deleting the app ends these terms for you. We may suspend or end your access to the beta program or the AI service if you materially breach these terms, or if we discontinue the service. The sections on your content, warranties, liability and governing law survive.
If these terms change, the date at the top changes with them, and material changes will be called out in the app's release notes. Continuing to use Momentum after a change means you accept the updated terms.
These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you and Epsilon each consent to that jurisdiction. If you're a consumer in a place whose law gives you the right to bring a claim locally, this doesn't take that away.
